Storilstvo in udeležba v KZ-1 in sodni praksi

Avtor v prispevku obravnava ureditev storilstva in udeležbe v slovenskem kazenskem pravu. Prispevek gradi na dveh novejših zadevah iz slovenske sodne prakse, ki ju uporabi za izhodišče razprave o ...zakonskih rešitvah, stališčih teorije in sodne prakse. Težišče prispevka je namenjeno problemu prepoznavanja in razlikovanja sostorilstva in pomoči. Tu avtor ponudi nekaj meril za konkretizacijo zakonske formule, da je za sostorilstvo potrebno "odločilno prispevanje k izvršitvi". Zavzame se za restriktivno pojmovanje sostorilstva, ki ne dopušča, da bi sostorilstvo utemeljili na prispevku, danem v fazi priprav na kaznivo dejanje. V sklepnem delu opozori še na nekatera druga sporna vprašanja, ki se nanašajo na ureditev storilstva in udeležbe v slovenskem kazenskem zakoniku.
